Terms of Service

You must be at least 16 years old (or the minimum age required in your jurisdiction, whichever is higher) and capable of entering into a binding contract to use the Service. If you use the Service on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms, and the words “you” and “your” refer to that entity.

• You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information and to keep your account information up to date.
• You must notify us immediately at security@gofaceless.io of any unauthorized access or suspected security incident.
• One person or legal entity may not maintain more than one free account without our prior written consent.

• GoFaceless is offered on a subscription basis. Pricing, features, and billing intervals are described at checkout and in your account.
• Payments are processed by Stripe, Inc. By subscribing, you authorize us (through Stripe) to charge your payment method on a recurring basis until you cancel.
• You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial subscription periods or unused time.
• We may change pricing with reasonable advance notice. Price changes apply to the next billing cycle after notice.
• You are responsible for all applicable taxes, duties, and government charges associated with your use of the Service, other than taxes based on our net income.
• If a payment fails, we may suspend or terminate your access to paid features until payment is resolved.

You agree not to use the Service, directly or indirectly, to:

• Violate any applicable law, regulation, or third-party right, including intellectual property, privacy, publicity, and data protection laws.
• Create, upload, generate, distribute, or promote content that is unlawful, defamatory, harassing, threatening, hateful, sexually exploitative of minors, or that infringes the rights of others.
• Engage in spam, phishing, scams, or any form of fraud or deceptive practice.
• Generate or distribute content that impersonates a real person or entity without authorization, or that is designed to mislead audiences about its origin or authenticity in a manner that violates applicable law or platform policy.
• Engage in artificial amplification, fake engagement, coordinated inauthentic behavior, view or follower inflation, or any activity prohibited by the policies of the third-party platforms with which GoFaceless integrates.
• Reverse engineer, decompile, disassemble, or attempt to discover the source code or underlying ideas of the Service, except to the extent such restrictions are prohibited by applicable law.
• Use automated means (including bots, scrapers, or crawlers) to access the Service, circumvent rate limits, or extract data, except through officially documented APIs and with our prior written permission.
• Interfere with, disrupt, or compromise the integrity, security, or performance of the Service or any infrastructure associated with it.
• Use the Service to build or train a competing product, to benchmark against GoFaceless, or to copy its features or user interface.
• Sublicense, resell, rent, lease, or otherwise commercially exploit the Service, except as expressly permitted in these Terms or in a separate written agreement with GoFaceless.

We reserve the right to investigate and take appropriate action, including issuing warnings, removing content, suspending or terminating accounts, and reporting activity to law enforcement and third-party platforms.

You retain ownership of the content you upload, create, generate, or store using the Service (“Your Content”). You grant GoFaceless a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, create derivative works of, and display Your Content solely to the extent necessary to operate, provide, secure, and improve the Service, to execute the actions you authorize on connected platforms, and to comply with legal obligations. This license ends when you delete Your Content from the Service, except to the extent copies remain in backups for a commercially reasonable period or retention is required by law.

You represent and warrant that you have all rights, licenses, consents, and permissions necessary to upload Your Content and to authorize GoFaceless to use it as described in these Terms and to publish it on connected platforms.

GoFaceless integrates with third-party platforms exclusively through their official APIs. Your use of those integrations is subject to the terms, policies, and community guidelines of each platform in addition to these Terms. If there is a conflict between these Terms and a third-party platform’s terms with respect to data or content obtained from that platform, the third-party platform’s terms control for that data and content.

6.1 YouTube API Services

GoFaceless uses YouTube API Services. By connecting a YouTube or Google account, you agree to be bound by the YouTube Terms of Service and acknowledge the Google Privacy Policy. You agree to comply with all YouTube and Google policies applicable to your use of the Service, and you may revoke GoFaceless’s access at any time at security.google.com/settings/security/permissions.

6.2 TikTok

GoFaceless uses TikTok developer APIs including the TikTok Login Kit and the TikTok Content Posting API. By connecting a TikTok account, you agree to comply with the TikTok Terms of Service, the TikTok Community Guidelines, and all other applicable TikTok policies. You are responsible for ensuring that content you publish to TikTok through GoFaceless complies with those policies.

6.3 Meta (Instagram and Facebook)

GoFaceless uses Meta platform APIs including the Instagram Graph API and the Facebook Graph API. By connecting a Meta account, you agree to comply with the Meta Terms of Service, the Instagram Terms of Use, the Meta Community Standards, and the Instagram Community Guidelines. You are responsible for ensuring that content you publish through GoFaceless complies with those policies and that you have the right to manage the Meta assets you connect.

6.4 X

GoFaceless uses the X API. By connecting an X account, you agree to comply with the X Terms of Service, the X Rules, and all other applicable X policies. You acknowledge that content published to X through GoFaceless is subject to X’s moderation and enforcement actions.

6.5 Stripe

Payments and payouts are processed by Stripe, Inc. under the Stripe Services Agreement and the Stripe Connected Account Agreement, as applicable. If you participate in the GoFaceless affiliate program, payouts are made exclusively through Stripe and you must complete the Stripe onboarding requirements before receiving payments.

GoFaceless makes no representation or warranty regarding the availability, reliability, or policies of any third-party platform. If a third-party platform changes or discontinues API access, features of the Service dependent on that platform may be modified or discontinued without liability.

Participation in the GoFaceless affiliate program is subject to additional terms presented at enrollment. Commissions are calculated and paid exclusively through Stripe in accordance with the published payout schedule. GoFaceless reserves the right to suspend, adjust, or terminate affiliate accounts and to withhold or claw back commissions in cases of fraud, refunds, chargebacks, abuse, or violation of these Terms or the affiliate program terms.

The Service, including its design, code, text, graphics, logos, trademarks, and underlying technology, is owned by GoFaceless or its licensors and is protected by applicable intellectual property laws. These Terms do not grant you any right, title, or interest in the Service, our trademarks, or our branding, except for the limited license to use the Service as described in these Terms.

Feedback or suggestions you provide about the Service are non-confidential, and you grant GoFaceless a perpetual, irrevocable, royalty-free license to use them without restriction.

GoFaceless respects the intellectual property rights of others. If you believe content on the Service infringes your copyright, send a notice containing the information required by the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)) to legal@gofaceless.io. We will respond to valid notices in accordance with applicable law and may remove allegedly infringing content and terminate repeat infringers.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to all or part of the Service, with or without notice, if we reasonably believe that you have violated these Terms, that your use creates risk or possible legal exposure for GoFaceless or other users, or that we are required to do so by law or a third-party platform. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination will survive, including ownership provisions, disclaimers, limitations of liability, indemnification, and dispute resolution.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. GoFACELESS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF HARMFUL COMPONENTS. REVENUE, GROWTH, ENGAGEMENT, AND PERFORMANCE OUTCOMES ARE NOT GUARANTEED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL GoFACELESS OR ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GoFACELESS’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID GoFACELESS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM AND (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to defend, indemnify, and hold harmless GoFaceless and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, (d) your violation of any applicable law or the policies of any third-party platform, or (e) your violation of any third-party right, including intellectual property, privacy, publicity, or data protection rights.

We may modify, suspend, or discontinue all or any portion of the Service at any time, including by adding or removing features, limits, or integrations. We may also update these Terms. Material changes will be announced in the product or by email, and the “Last updated” date at the top of this page will be revised. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

These Terms and any dispute arising out of or related to them or the Service will be governed by the laws of the jurisdiction in which GoFaceless is organized, without regard to its conflict of laws principles. The parties submit to the exclusive jurisdiction of the courts of that jurisdiction for any dispute not subject to mandatory consumer protection laws in your place of residence. Nothing in these Terms affects the mandatory statutory rights you may have as a consumer under the laws of your country of residence.

• Entire agreement. These Terms, together with the Privacy Policy and any additional terms presented at enrollment (such as affiliate program terms), constitute the entire agreement between you and GoFaceless regarding the Service.
• Severability. If any provision is held unenforceable, the remaining provisions will remain in full force and effect.
• No waiver. Our failure to enforce any right or provision will not be a waiver of that right or provision.
• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
• Force majeure. Neither party is liable for any failure or delay caused by events beyond its reasonable control.
• Relationship. These Terms do not create any agency, partnership, joint venture, or employment relationship between you and GoFaceless.
